Membership Terms

1. Platinum Studio Pilates reserves the right to change hours of operation, services offered and all fees and charges, at any time, at its sole discretion and without prior notice to our clients. Any such changes will be notified to you through either a newsletter published from time to time, the website, notices in the studio and/or mailing / emailing to your last known address.

2. It is your responsibility to ensure that you correctly operate any Studio facilities or equipment. If you are in doubt as to how to correctly operate or use any club facilities or equipment, you must consult a Platinum Studio Pilates staff member for assistance.

3. No one has made any representations (whether verbal or written) to induce you to enter this Agreement and that no verbal agreements or understandings have been made with Platinum Studio Pilates unless as set out in this Agreement.

4. You must inform Platinum Studio Pilates of any change in your contact details, bank accounts or credit card details for payment, or any other information relevant to your Registration.

5. You will receive marketing correspondence via electronic transmission on regular basis which may include (but not limited to) newsletters and promotional material. You may unsubscribe at any time.

Platinum Studio Pilates Unlimited Gold Memberships are for a minimum period of twelve (12) months. The cost is $50 per week, paid in advance. You can cancel at any time after the 12 month minimum term with 30 days notice. Gold Memberships are set to Auto Renew unless you provide 30 days notice before the expiration of your 12 month term. Memberships are billed weekly via credit card. No refunds, transfers or extensions are available.

Platinum Studio Pilates Unlimited Silver Memberships are for a minimum period of six (6) months. The cost is $55 per week, paid in advance. You can cancel at any time after the 6 month minimum term with 30 days notice. Silver Memberships are set to Auto Renew unless you provide 30 days notice before the expiration of your 6 month term. Memberships are billed weekly via credit card. No refunds, transfers or extensions are available.

Members are entitled to suspend their Membership for a maximum period of 4 weeks per Gold Membership and 2 weeks per Silver Membership Term. All suspensions are in blocks of 7 days, and a minimum of 7 days notification prior to the requested suspension is required via email to admin@platinumstudiopilates.com.au.

Memberships and class bookings are Not transferable.

Minimum Age

6. Registration and use is limited to persons who are at least 16 years of age.

Cancellation Policy

7. Platinum Studio Pilates has a Cancellation Policy which requires cancellation of a class booking with at least 12 hours notice prior to the scheduled booked class, otherwise the full class fee applies. We do understand that sometimes unforeseeable circumstances can occur, but we have a strict, consistent and fair policy for all of our clients, therefore, no exceptions will be made to this policy. If you make a booking, double booking, and/or fail to attend, without providing at least 12 hours notice of your cancellation, you will forfeit the cost of your class. Members will be charged a $15 late fee.

Physical Condition

8. You are required to complete a Pre-Exercise Questionnaire as part of your Registration . You must notify Platinum Studio Pilates of any change in your health and fitness so that your training regime can be appropriately modified. In the event of pregnancy, members must notify Platinum Studio Pilates before continuing to use the facilities.

9. Any advice and/or recommendation by a Platinum Studio Pilates Fitness Instructor / Employee is not intended to constitute medical diagnosis or treatment, nor should it be relied on as a suggested course of medical treatment for a particular condition. If you are in doubt, you should obtain medical advice prior to commencing any exercise program.

10. You must not use any Platinum Studio Pilates facilities whilst suffering from any infections or contagious illness, disease or other ailment or whilst suffering from any physical ailment such as open cuts, sores, or minor infections where there is a risk (however small) to other members and guests.

11. You are aware that the use of the premises and its facilities and your participation in classes and programs conducted by Platinum Studio Pilates may involve strenuous activity and special risks.

12. You warrant that you are physically able to participate in any classes/fitness program or use any club facilities in which you have chosen to participate, and have not been advised otherwise by your medical practitioner. You further warrant that you have no pre-existing medical condition that would otherwise prevent you from using the club facilities and/or participating in any classes/fitness program.

You understand that you will be engaging in activities that may involve risk of personal injury or illness and which may also involve the risk of economic/property loss and damage. You also understand that there may be risks involved that are not known to you or to Platinum Studio Pilates, or may not be foreseen or reasonably foreseeable at this time or at the time of using the club facilities or participating in the class/fitness program. You assume the foregoing risks including risk of any negligence by Platinum Studio Pilates and its respective owners, directors, officers, employees or agents, and accept personal responsibility for any injury (including but not limited to personal injury and disability), illness, damage, loss, claim, liability or expense of any kind or nature, that you may suffer arising out of or in connection with the use of club facilities or participation in classes/fitness programs by you, or any minor/person under your supervision, care or control.

Platinum Studio Pilates reserve the right to stop and/or prevent anyone attending their class(es) if we feel that your physical condition and/or ability may present a problem. This is at our sole discretion.

Limitation of Liability

13. In consideration of the grant of use of our Studio to you, you hereby release and forever discharge Platinum Studio Pilates from all actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses howsoever arising that you may have incurred arising from or in connection with your use of Platinum Studio Pilates facilities and equipment, or from being on studio premises to the fullest extent permitted by law and whether caused or contributed to (directly or indirectly) by any act of negligence, breach of duty or default/omission on the part of Platinum Studio Pilates and its respective owners, directors, officers, employees or agents.

14. In consideration of the grant of use of our Studio to you, you agree that Platinum Studio Pilates will not be liable for any loss, damage or theft of any of your (or your guest’s) property except where caused by the gross negligence of Platinum Studio Pilates. Further, Platinum Studio Pilates will not be liable for any death, personal injury or illness occurring on club premises or as a result of use of facilities or equipment, except to the extent that it arises from the gross negligence of Platinum Studio Pilates and its respective owners, directors, officers, employees or agents.

Payment Terms

15. All payments must be made through our website and/or App wherein you will be directed to mindbodyonline for payment and bookings of class. Payments made by credit card will attract a credit card processing fee.

16. You will be permitted to buy casual and/or group visits to our Studio and bookings can only be made with credit through your mindbodyonline account through our App and/or Website.

17. Platinum Studio Pilates does not and will not accept any payment, cash, credit card and or otherwise at our Studio. All payments are made using our Website and/or App.

18. All fees and charges are subject to Clause 2 of this Agreement.

19. In the event of default or arrears of payment, you are aware and agree that Platinum Studio Pilates may recover any amount unpaid for the balance of Membership and any other fees or charges that remain unpaid, and that we may engage the services of a legal representative and/or credit recovery agent and they may do all things necessary to recover all amounts outstanding to Platinum Studio Pilates including but not limited to all costs in the recovery of the same and filing on any Credit Rating records.

20. In the event of payment defaults on Memberships, you will be charged a default fee of $15, for each time there is a default in payment. Where there are 2 or more defaults, your Membership may be terminated, with prior money missed payments and remaining payments relating to the Membership still payable. This is at the sole discretion of Platinum Studio Pilates.

 

2. Rules and Regulations (Guidelines)

 

Code of Conduct

The Code of Conduct must be adhered to by clients of Platinum Studio Pilates to maintain a safe and enjoyable environment. Clients should respect the health and safety of each other while on the studio premises and must comply with Occupational Health and Safety requirements of the club. Any internal signage displayed around the studio forms part of the Membership Rules and Regulations and should be treated as part of the Code of Conduct. If a guest is seen to be in breach of the Code of Conduct or Rules and Regulations, Platinum Studio Pilates reserves the right to terminate the registration and take further action if deemed appropriate.

Damage to Property

Any guest who causes damage to equipment or any property of Platinum Studio Pilates will be held liable for damages. Guests will be held responsible for damage caused by children or guests.

Dress Code

Guests must wear suitably and respectable gym training attire at all times. Guests must wear grip socks and full finger gloves at all times.

Equipment

All equipment must be returned to their rightful place after use in all areas of the studio, and all equipment properly wiped down with hygienic wipes that are provided.

Smoking

Guests acknowledge that the studio premises are non-smoking.

Hygiene and Cleanliness

A clean sweat towel is provided and must be used at all times while training at the studio and placed back in the baskets after each class. All equipment must be wiped down using the hygienic wipes provided, after each use.

Open Shelves

Open Shelves are provided for use ONLY while the guest is training in the club, and are used at the guest’s own risk. While all care is taken, Platinum Studio Pilates will not be held liable for any loss, damage or theft of belongings placed in these shelves or brought on the premises. Unclaimed property will be kept for 14 days and thereafter donated to charity.

Privacy & Security

During or immediately prior to your Registration, we may obtain certain personal information (such as about your health). Platinum Studio Pilates will only use, disclose or deal with such information in accordance with its Privacy Policy, which can be provided to you or accessed at the Platinum Studio Pilates website www.PlatinumStudioPilates.com.au additionally, for safety and security reasons Platinum Studio Pilates use surveillance in common areas. You may not take any recording or take any photograph of any person without the authorisation of that person. 

Pregnancy

As a member - for your safety, if you fall pregnant, your access to certain classes may be denied.

Studios

Guests are only permitted to access studios under the supervision of a Platinum Studio Pilates instructor or trainer. No glass bottles are to be taken into studios .

Warm Up

Out of consideration for other clients and the instructor and also for your own safety, the warm up is an important aspect of each class. Please be aware that if you are more than 5 minutes late for a class, the instructor may not allow you to participate in a class. This is determined at the Instructor’s sole discretion. In the event of late attendance, you will forfeit the class and not be entitled to a refund or credit.

Extensions

Any guest requesting an extension to a pack and/or suspension of Membership on medical, family assistance grounds, etc., must provide any documentation as required by Platinum Studio Pilates including but not limited to Medical Certificates. In the absence of any substantiating supporting material, Platinum Studio Pilates reserves the right to not grant an extension to the time remaining on a pack or a suspension.

Introductory Offer & New Clients

There is a limit to one Introductory Offer per client regardless of any length of time in between your last and current visit. If you are found to have purchased this offer more than once, you agree to be charged the casual class rate of each class that you attend. The Introductory Offer is non-refundable, nor transferable and will activate from the date of purchase.

All new clients need to arrive at least 15 minutes prior to the commencement of their first class. You will need to complete a paper registration form, introduce yourself to the instructor, relay any issues you may have and have the instructor orientate you with the reformer machine.

Not Transferable

All clients must have their own registration and credit on their own account. No Packs, Contracts or Memberships are transferable under any circumstances. If someone other than the person booked into the class arrives to use the class, they will be refused access to the class. You will not receive a refund for this class and we reserve the right to cancel your access to our Studio.

Gift cards are non-refundable and non-transferable.

Closure of Business

In the event of any closure of Platinum Studio Pilates outside of our control - such as a Health and Safety issue, all Contracts, Packs and Memberships will be suspended for the duration of our closure and upon re-opening of Platinum Studio Pilates all Packs, Contracts and Memberships will resume with remaining periods beginning from the re-open date.

Refunds & Exchanges

Platinum Studio Pilates does not provide a refund for any unused pack, contract and/or Membership, nor do we provide credit.

Waitlists

If a class you wish to attend is fully booked, please add your name to the waitlist. Should a place become available, then you will receive either an email or text from us confirming if you have been moved from the waitlist to the class. The 12 hour cancellation policy applies to those who have put themselves on the waitlist for a class also. If you know you will not be able to make a class that you have waitlisted yourself on, it is your responsibility to remove yourself from the waitlist. You need to ensure that you turn on email notifications in your Mindbody account in order to receive an email confirming that you have been moved from waitlist into the class. If you don’t wish to receive emails, you must ensure that you switch on mobile notifications in your Mindbody Account to get a text message notification confirming that you have been moved from Waitlist into the class. Should you miss the class due to not having your notifications switched on or set up properly in Mindbody or due to not checking your schedule in MindBody, you will forfeit that class or if you in an unlimited Membership, you will be charged a $15 fee according to the cancellation policy.
